The main responsibilities of the Hazardous Materials program are to perform site investigations and to provide direction to ARDOT activities related to hazardous and solid waste management. ARDOT is responsible for identification, investigation, characterization, and possible remediation of the hazardous material site(s) within existing or proposed right of way. Environmental Site Assessments and new property acquisition studies are also conducted and identification of potentially hazardous materials within the proposed right of way and regulatory procedures are sometimes needed.
Site investigations are routinely conducted by ARDOT during the NEPA process. These assessments are conducted under established environmental site assessment procedures. These environmental site assessment investigations address the burden of acquiring all or portions of a property under the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA), the Superfund Amendment and Reauthorization Act (SARA), and the Hazardous and Solid Waste Amendments (HWSA). For sites requiring remediation, ARDOT conducts the necessary coordination with the Arkansas Department of Energy and Environment, Division of Environmental Quality (DEQ) and the U.S. Environmental Protection Agency (EPA).
